  • I-751

My wife and I just filed our I-751 a few months ago. Our initial interview was about 5 mins long. We have submitted taxes, lease agreements, insurance policies with each other as beneficiarie, joint bank accounts, etc. We dont have all utilities under one name cuz i just set it up and she set it up as we had a chance. I was wondering if they call for interview what types of things they look for or what exactly they are needing. I have read post where it seems like the USCIS give hassle to the most honest cases as well, so i just want to know whats going on.

Hi Mike, thanks for taking the time. I went for the initial interview we first applied almost two years ago. But now we are applying to get the condition removed. We have submitted evidence but are told sometimes they call for another interview if they feel thats needed. What do they base that on interview on? is it because they feel something is wrong or what? how can they determine a marriage is fraud when my wife and I are both there and we both say this is true. I dont understand that. is the burden of proof on us or them to prove its a fraud since the first interview the burden was on us. Thanks for the input.

It sounds like a fraud to me.

For I-751, the alien applicant should be submitted with evidence showing a shared life with your U.S. citizen spouse. The USCIS Service Centers may approve, deny, request further evidence, or send your case to the local district office for interview. Within the one-year period of time, USCIS will adjudicate your application.

              anti virus,
you have been on this board for that long and asked so many millions of questions about the i-751 and now u finally filed for it and still wonder if u fliled enough.

I mean U knew ahead of time,to have the house bills under the same name,by reading stories after stories on here...

anyway, if the marriage is indeed REAL,nothing will happen and it will be fine.

People should imagine they are the ins officer reviewing your application, and grab your i-751 package and read it like u are the officer to determine if this marriage was real and entered with good faith.
Then you can say "yes, beyond the shaddow of a doubt, this is real as it gets" as far evidence goes.

              Good Luck!

PS: For anyone filing the I-751, the basic stuff that needs to be submited, and if the marriage is real, you have all these things.

              1. Joint Tax Returns

              2. Pictures, - dating period,engagement perdiod,marriage period,family pictures together,vacation pictures together etc etc.

              3. Joint APT lease or House under both names.

              4. Joint Health Insurance

              5. Joint Bank accounts - Credit Cards

              6. Joint Car Insurance

              7. Joint Utility bills, showing same address

              8. Being eachothers beneficiary on life insurance.

              9. IF trips taken together "plane tickets" showing traveled together.

              10. Sworn Notorized Affadavits from US cititzens family members and U.S. citizen friends, attesting the marriage is indeed real and with love.
Anyone who has a fake/shame marriage can not provide these affadavits because, people can be prostecuted and jailed if lied on an affadavit.
Which is actually a Felony lying to officers aka homeland security, which is the INS!

Thanks HBKHBK, we have most the above mentioned evidence. Our lawyer didnt push for the affadavits, because he feels our case is strong enough, but I guess i am just a bit paranoid and dont like to take chances with USCIS. Being on this forum is just for re-assurance, cuz if i ask my lawyer for re-assurance it cost me $$$ :-)

I would always advice to add affadavits, regardless what a lawyer or anyone else says, because it just adds certainty to your evidence.
The goal is,the officer reviewing your application, should not have any doubts about marriage honesty.

Ps: You do not need an attorney really for the I-751, Its a waste of money really.

                  Eitherway,

Good Luck buddy..it will go fine!
