  • Work Employment Issue

    Hi,

I am new to this forum and think this place will help to many people with immigration issues. Ok, so for the last 3 years I have been working in USA under J-1 Visa program (E212 rule does not apply). Now I've got F-1 Visa. I read somewhere that I will be able to work 20 hours off-campus or on-campus and more than 20 hours while not in school. Is this true? What is in the reality (like I am real work-o-holic)? And one more thing on my ss card is written "Valid with INS authorization".

You should check with the foreign student advisor on campus about how this works. It's my understanding, from secondhand information, that you can work part-time during the school year (as long as you're maintaining full-time student status) and full-time during breaks.

Hi, you may be allowed to work on-campus or off-campus (after the completion of your first year of study) under limited circumstances. You may wish to discuss employment with the designated school official (DSO) at your school.

        Read Sec.214.2(f)(9) for employment requirements.

To qualify to work off campus, you must demostrate severe economic hardship, must be in good standing at the educational institution by carrying a full course load, and demostrate that acceptance of employment will not interfere with the studen't course load, and must have been on the F 1 visa for at least a year. See INA Section 214.2

It is interesting that one DSO is convincing me that I really do not have to wait 1 year before I can engage in off-campus employement. She could lie to ne....

Some DSO's are very strict and others are very lienient. I believe You can work off campus without proving economic hardship and during your first year IF you are participating in an approved internship. The school must approve the internship and the DSO must sign off. Depending on where you go to school this could be a very easy or a very difficult process.

It sounds like ti will be nice solution but how about the internship regulations? Do you think I will be put on some restricion that most internships (at least for J-1) have such as section 212(E) two years border crosing ban. Thank you.
