Voluntary Departure

I have decided to go home after overstaying my tourist visa for 3 years. there has been no removal proceedings against me, nor there have been any deportation issued.

What do I do so that I can just go home, Do I just purchase a ticket and depart?

If I do just go home and they realized I have overstayed my visa, what does immigration do to me?

I understand that my going home will void my visa and i will have that ten year bar, but other than that, can i go home without any hocus. Will they just let me pass through, or am i going to go through a lawyer, judge and fingerprinting and all that?

Please advise as I am looking to leave in a week.

you can leave, you should not have any problems. However, you know that you will have issues with getting a visa later on and reenter the United States.
Is there any way you can get married to a US Citizen?

also, what kind of visa were you under, cause if it is a student visa, then unless the immigration officer or the immigration judge finds you in violation, the bar will not apply.

Just purchase an airline ticket and go home. Do not show your passport at your home country's airport. Or, have you passport back date at the airport if possible. I heard some people do this. As far as your I-94 goes, I am not sure if the immigration really keeps track of the date it was given and if it really goes to the database with your name.

Thank you Everyone!!! Depo Man---Why don't you go and do something worthy of your time, instead of putting down everyone. You obviously have nothing better to do than to sit and wonder how you can annoy everyone else in the world. Get a life!

But for all the rest who have offered insight, thank you. It means a lot to me.

I don't think about marriage right now, as my urgency to go home has something to do with my family, I don't know if I will be able to come back at all.

I came as a tourist. All I want to do is just go home, that's all..

When my friend had voluntary departure he had to go to the embassy in his town and sign in...to show proof he followed through...
Also, keep your airline tickets in case they need more proof...Since you did enter originally legally on a visa..i dont think the ten year bar will apply.

Thanks GG, do you happen to know how he got home? I mean did he just purchase the ticket and left, and immigration just let him pass thru. The thing is, I am terrrified of being detained or anything like that. I would very much like to go home if they just let me pass thru, even if voiding my visa for future use but if I am going to be detained and stuff, I don't know if I could bear it...

Any advice is helpful on this matter.

No one at US govt checks your status when you are LEAVING the US;you only get checked by your airline to be sure you have a visa to the country your flight is going to or ending at.

Are you 100% sure that you will not want to return to the US in the next 10 years? I think the 10 year bar will apply to you.

But if you MUST leave, feel free to do so, no one will hold you up anywhere.

I am leaving any day now, is there any preference to an airport that I should take? I was thinking San Jose International Airport, since they are less probably on security and stuff. But I have only available flight from San Francisco. ( still scared)
