  • RELEASE FROM DETAINMENT

    Dear Anyone who can help!

I've very concerned if I'm going about this the right way and would really value the opinion of anyone who has knowledge of the immigration circuit.

My Father is a 55 year old British Citizen who has lived in this country (with a Green card) for over 28 years. He has been under DHS detention for the last 22 months, and currently is at Osborn C/F in Somers, CT. He lost the BIA appeal, and has been in the 2nd circuit for the past 6 months. His aggravated felony that caused this deportation proceeding was vacated three weeks ago in the State of Maine.

Jim Brown who heads the Immigration department in Hartford said that he would not oppose my Father's release. Brown's trial attorney also said that my Father could simply file a motion to reopen and motion to terminate in Hartford Immigration Court and he could be released in a few days.

On the other hand, our Attorney Michael Moore is saying that a motion to reopen has to go to the BIA in Virginia instead and that it could take up to three months.

Would you please assist me in what the best method of gaining his swift release would be?

Thank you in advance as I'm desperate for good advice!

    Kindest Regards,
    Eric
