Tell me truthfully davdah, would you seek damages if you or a loved one were to be permanently disabled because of a medical mistake or would you accept the $10k the hospital or doctor offered? You sure wouldn't do that if involved in a car accident and the other person's auto insurance company approached you with an offer and an assurance you won't seek further damages later would you?

Dunmore woman gets $1.88 million in medical malpractice case
A Lackawanna County jury awarded a Dunmore woman $1.88 million in a medical malpractice lawsuit filed on behalf of her husband, who died of cancer in 2008.
Christine Golden sued former Scranton urologist Milan J. Smolko, pathologist Lillian Longendorfer and Wayne Memorial Hospital in Honesdale for failing to diagnose her husband's bladder cancer despite several consultations and examinations between Sept. 18, 2002, and January 2004.
Before the verdict was returned last month, however, Dr. Longendorfer and the hospital reached a confidential settlement with Mrs. Golden. Dr. Smolko has appealed the jury verdict; neither he nor his attorney could be reached for comment Tuesday.
Mrs. Golden's lawyer, James E. Foerstner of the Beasley Firm in Philadelphia, said Terrence E. Golden saw Dr. Smolko multiple times in those 16 months, each time complaining of urinary problems. Dr. Smolko said he had an inflamed and enlarged prostate, but did not investigate further until July 2003. Then, he did a bladder biopsy and sent the information to Dr. Longendorfer, who worked at Wayne Memorial Hospital.
She also failed to diagnose Mr. Golden's bladder cancer, Mr. Foerstner said.
Another doctor diagnosed Mr. Golden's cancer in June 2004. By then, the cancer had spread and Mr. Golden underwent surgery to remove his prostate, bladder and portions of his urethra. He died Jan. 21, 2008, soon after doctors had told him his cancer was no longer treatable. He was 60.
Had Dr. Smolko or Dr. Longendorfer diagnosed him properly, Mr. Golden's death may have been avoided, Mr. Foerstner said.
Mr. Foerstner said the jury's verdict was a "bittersweet victory."
"Her husband was vindicated," the attorney said. "But it doesn't bring him back."

RAND STUDY FINDS CALIFORNIA MEDICAL MALPRACTICE AWARD CAPS HAVE CUT PAYMENTS BY 30 PERCENT TO THOSE WHO WIN LAWSUITS
The problem with medical malpractice caps is they create an unfair situation.
Person A is permanently injured as a result of a medical mistake. He was working.
Person B is not working for whatever reason.
Under CA's law, Person A will get an economic award equal to lost wages regardless of any additional malpractice award he might get.
Person B gets no economic award and might get as little as $10k discretionary award from the hospital or doctor. It's hard to get a lawyer to take on a good case in CA because they won't make much from any malpractice award. Considering it can take years to bring a case in court and teams of people to do so, it's not that surprising.
Person B gets shafted because of the malpractice cap. The award is intended first of all as a punitive measure. It also acts as a way of compensation for those who wouldn't otherwise qualify for economic compensation.
Once again davdah, if you or your loved ones were to be involved in a medical malpractice case, you would be the first one to get a lawyer, I guarantee it. It's called the "Trent Lott" effect.

CA has a medical malpractice cap of $250k (for pain and suffering). You might see half of that in the end if your lucky. Of course the hospital will try to pay you off with $10k first.

Study suggests declining political influence of physicians
Pharmaceutical companies spend more money lobbying Congress than other health care organizations, according to a new study in the April 1, 2004 issue of the American Journal of Medicine. Meanwhile, lobbying by physicians lagged behind, suggesting a decline in their political influence. By reviewing reports required by the Lobbying Disclosure Act, the investigators found that health care lobbying expenditures totaled $237 million in the year 2000.
"Among health care organizations, drug companies spent the most on lobbying, $96 million, followed by physicians and other health professionals, $46 million. Hospitals and nursing homes spent $40 million while health insurance and managed care organizations spent $31 million. Disease advocacy and public health organizations spent only $12 million."

The field of medicine is filled with doctors devoted to improving lives and protecting patients.
Trial attorneys also are passionately committed to these identical principles. America's fair and open legal system helps injured people seek recourse and leads to improved safety methods and standards.
Some believe altering the civil justice system is the answer to this country's health care woes. Ultimately, this will not make anyone healthier or save one life. I've never said it's free. It's paid for through taxation. That's the beauty of it. You pay into it when you are working and are able to use it REGARDLESS of if you have an income or not at the point of use. Quite simple really.
USA spends 16.2% of GDP on healthcare. UK spends 8.5% of GDP. Which is cheaper??
And you don't get scenes like this in a supposedly civilized contry...

And it's genuinely free. No taxpayers or insurance money involved because it's a charity. Sad there is such a need for it here.
