  • Complex Topic..but I need help to start somewhere

    Okay..here it is. Quite complex. I came here 4 years ago on tourist visa, obviously overstayed. A few months ago I got married but was married to well let's just say that no matter how much I wanted my green card there was no way I would stay with this guy. I got divorced. Now I have a fiance, for real this time. We are hoping to get married soon.

    I got into a legal trouble which will really give me a problem when I file for my papers. I don't know what to do. I was thinking of going home, evading any problems before they arise and start over again with a fiance visa. Will that work?

    My fiance is willing to find a way.
    But I don't know where to start. Please help me

      whats the legal trouble you got into?

      I think if you marry this guy you will be fine.

      You will not get another visa if you try to go back home and return and you will be barred from returning to the US for 10 years because you were out of status for a long time.

        I took care of someone for the last two years, now the wife, is making a lot of false accusations towards me and is intent in bringing me down.

        I thought maybe I would go home change my name and try again. This time with my fiance marrying me in my country.

          Do you mean that the wife is saying that you s lept with their man? If thats what it is, thats not big legal trouble

          I would not advice you to do what you are trying to do because trust me, you will get caught somehow. For example, if you go back anc hange your name, do you mean you will get a totally new identity, birth date and so on? How will your country issue you a new passport when records show that someone with the same birthdate and name exists? This may need you to get a new birth certificate and assume someone else's identity, all of which is very very illegal.

          I think that would be called fraud.
