Question regarding form I-864

  • Question regarding form I-864

    The checklist for the form states the following:

    "The following items must be submitted with Form I-864, Affidavit of Support Under Section 213A:

    For ALL Sponsors:

    -This form, the I-864, completed and signed before a notary public or a Consular or Immigration Officer.

    -Proof of current employment or self-employment.

    -Your individual Federal income tax returns for the most recent 3 tax years, or an explanation if fewer were submitted. Your W-2s for any of the most recent 3 years for which you filed a joint tax return but are using only your own income to qualify. Forms 1099 or evidence of other reported income if necessary to qualify."

    My dilemma is this:

    My mother is filing as a joint sponsor and has provided me will all the required documentation, however, I do not have my income tax returns for the past 3 years. I am currently temporarily residing in Germany with my husband and have no way of obtaining my tax returns for the previous 3 years, and if there is a way to do it from here, I have no knowledge of it.

    My question is if I am not trying to claim any income to meet the requirement, as my parents' income is sufficient alone, do you think I will still need to have my tax returns? If so, do anyof you know where I can obtain them from here?

      I presume you are the US citizen spouse. If so, you are the principal sponsor and yes you will have to provide the tax return(s) as required.
      You can request tax transcripts directly from IRS.
