    Does anyone know if I need to file form I-864 for a green card application? My wife got a job as Registered Nurse, and the hospital she is working for agreed to sponsor the green card. I am not sure if we need to file this form since the hospital is our sponsor, and this form requires an additional sponsor. Both of us are from a foreign country. Please reply ASAP. Thank you.

      Since it would take at least couple of minutes for me to do research ( = put extra effort ) to answer your question accurately, I am not going to tell you the exact answer.


      However, you should know that there is, among many others, a wonderful tool called 'google' research engine.

      You should type in 'I-864' or related terms and press 'search' bottom - then simply click on "Form I-864, PDF version" and read instructions of the form - it will tell you if you should file it.

      If you have difficulty understanding 'instructions' then you can also read relevant to 'I-864' articles under original search results and get all the info you need.

        If the hospital is sponsoring her, they will (or should) do the paper work. You do not need to file anything. The I-864 is for sponsorship on family based applications. She will have an employment based application. They are different.

        I believe that you should also be able to obtain derivitive status and get your green card at the same time she gets hers. Make sure they apply for 'to follow' benefits.
