  • Part 2 of I-485 form

    Not sure which of these to check. I am trying to complete this form for my husband who is from Uruguay. I am a US citizen born in the United States. Can someone assist me with Section 2 of this form. Thanks so much.

          He is here in the United States. Thanks so much for your help. I think I am a fairly smart girl but I am just not sure about some of these questions. Thanks again for your help.

            Check box "a" if you have an already approved immigrant petition. Or "b" if an adjustment of status was applied for previously.

              Sorry, I am still a little confused. We do not have an approved immigrant petition and also have not applied previously for an adjustment of status. We are filling out forms I-130 for me (since I am the US citizen) and I-485 for my husband who is from Uruguay. He came to the US in 2003 on an I-94 since as visa is not required from his country.

              Again, thank you so much for your help. You certainly seem to be the pro on here.

                Hi Wdhb,

                I believe you need to file the I-130 Petition for Alien Relative prior to the I-485. Once you have the approved I-130, then you will check Box a on Part 2 of the I-485.
