  • Marriage Immediately After GC

I received my permanent residency few days back. I had applied as US citizen's child over 21. I have not received my green card yet but my passport has a stamp that was put at the time of my successful interview.
I want to get married to my fiance' who is already in US on H1B. My question is , should I wait for my green and then get married or just go for it using my stamp in my passport as evidence of permanent residency?

The reason I ask is that I would probably have to inform USCIS about my change of marital status and change of name after marriage and I want to avoid the hassel of beaurocracy and paperwork before I receive my green card.

Any input and experiences in this regard would be greatly appreciated.
    thanks in advance!

I think it is better to wait for few more weeks and get your I-551 which can be used as your ID, with your photo, date place of birth, and you legal residency at the time of registering you marriage at local court house, along with your passport.
Get some certified copies of you marriage certificates.
Look into the Forms I think they do have a form for the change of Name.
      All the best.

        Adam: Thanks!

I can't believe it took only 1 week to get the actual green card in mail, yay!!!

Now my qs. to the board members is, how do I let INS know about my marital status? What forms I need to send them, I know I need to send AR-11 form for the change in address but what about the change in marital status?

Dear Rim. My son is in the same category
Could you tell me how long did the whole process take in your category. After fingerprinting how long did you wait for the interview? What did the interview go? What did they ask there.

            Hi,
I had applied for my GC as US citizen's child over 21. My priority date came and I have applied for change of visa status I-485, which is under processing. Now If I get married how can i sponsor my wife.
Will I loose my I-485, as I got the visa number as a child of unmarried US citizen.
What is the best way to go about this.
            Thanks

              Ilug:
I got my Interview notice within two weeks of my FP & Biometrics. The interview itself was scheduled two months after the actual Finger Printing. Interview was hardly 10 minutes long. The D.O.A asked some basic qs. like if I have ever committed any crime, if I am married or I have any kids? Then he went out with our I.Ds to make copies & took my passport, work permit & stamped the passport!

              Hey Jitubats:
My understanding is that if your petition was filed under unmarried children then U can't get married... I mean u can get married but it will jeopardize your case as it will move your case to a different category. Thats what my attorney & one of the attorney on ilw's chat session suggested me. My fiance & I waited 3 plus years for this process(read ordeal) to end. Luckily, he himself was in USA on F1 & now he is on H1 visa. V R going to file I-130 for him right after the big day but he has to maintain his non-immigrant status in USA until his priority date becomes available. If your fiance is not in USA, she can apply for a non-immigrant visa & then u guys can get married (i.e after u get your green card). But again, she will have to maintain her non-immigrant status.

Hope this will help u guys, but if you have more qs. feel free to ask!

              Good Luck!

I was wondering if I get married to her and I go on H1, then she can be here. What I was wondering is if my visa category changes from f1-->f3 then does my priority date remains the same. My priority date was 99 and right now the priority date is 98 for f3 ccategory. So if i go back to h1 and remain on the same for a year or so, get my gc when my visa number comes available.
Dunno know if this is a viable option for me right now or not.

Actually ur case is interesting as I bet U have already filed ur AOS. If so, then ur status is AOS pending, right? Unfortunately, I dunno anything about changing a status from AOS pending to an H1 visa. As far as retaining old priority date is concerned, the whole thing was pretty ambigiuous for us, thats y we didn't take any chance. As I mentioned, that my fiance/hubby needs to maintain his status while I-130 is pending, but even if for some reason he is unable to keep H1, we intend to move bk to Canada, get jobs & wait for his green card over there. This could be an option for you also... I mean u can move anywhere with ur spouse!
But, do consult a lawyer, explore your options & see what they have to say. Chk out www.murthy.com if u have any H1 related qs.

My attorney was very expensive and not much help. I did most of the research. So cant help you there.
Did you research about V Visa? This is a visa for non immigrant spouses of green card holders?
