Greetings! My husband received his permanent resident card in November of 2003. How long does he have to wait until he can apply for his citizenship? INS told us 3 years...is that really true?

He can actually apply 2 years and 9 months after the date of becoming a permanent resident... is 3 years by law if the alien is married to a USC but USCIS allows the alien to apply 90 days prior to becoming 100% eligible therefore is 2 years and 9 months...

Janet in your case after 2 years you guys have to apply for I-751 to remove condition on your green card. Meanwhile after 2 years and 9 months you can file for citizenship even though you are waiting in a long queue of I-751. I-751 needs to be approved first then they will call for citizenship interview. Both process I-751 and N-400 can go concurrently. Good luck.
