  • I-485 Denial--Options

    I have a friend whose lawyer might have screwed up her I-485 interview. He was supposed to be at the interview with her, and had some of her paperwork, but then didn't show up.

    My question is: this was her second interview. Her case is a little complicated, so I won't go into details, but my question is: if the I-485 app is denied, what are her options? Could she be deported without any opportunity to appeal, re-file, or any other recourse?

    The examiner told her there would not be any other interviews. It was very short, and she is concerned she didn't do well, because we was so upset about her lawyer not being there with here paperwork. Any information would be very helpful.

      Usually , if I-485 denied, they grab one right off the interview , put in helicopter and drop off somewhere over Mexican jungles.

      She got screwed, hehehehe

        what difference would a lawyer being there make?? You should have paid more money to the lawyer; obviously you offended him and he did not show up.

        How much did you tip the interviewer? I hope you did not skimp on that.

          Normal tip is $500-$1000; just put it on the desk before the interview starts and smile; if you forgot to do this, you should immediately mail it to the interviewer. Do not send a check ! Only cash is accepted. Make sure to incude your A number so they know who to give special treatment to.

              Welcome. I think your friend will have the right to appeal the denial. I am sure other members will drop by to explain the appeal process. Good luck to your friend.

                Welcome. I think your friend will have the right to appeal the denial. I am sure other members will drop by to explain the appeal process. Good luck to your friend. </div></BLOCKQUOTE>

                Your lawyer must be like Proudusc. Proudusc states, "I think your friend will have the right to appeal the denial." As opposed to some intelligent answer like your friend has a right to appeal within 30 days from the day of denial.

                  Instead of mocking me, why didn't you give her the proper answer in the first place? I am not a lawyer, but saw no serious responses in this thread, so I thought I'd try to help.

                    Hell Plas and welcome to the forum

                    Unfortunately, if you want help , you will have to provide some more details.

                    What type of interview is it? family or employment based?

                    Why was there a second interview?

                    How did she enter the country.. visa, visa waiver program and what type of visa if it was visa? Options of appeal/refile cannot be answered without answering some of the above questions.

                    Please provide short and simple story with timelines.

                      I'm afraid I don't have all of the details at hand. Her husband came over before her on a work visa and got a green card. However, they have different last names so while her son was also given legal residency, she was not.

                      I believe the second interview was (at least in part) to confirm that she and her husband are in fact married.

                      I'm not certain how she entered the country, but I know she does have a work visa. That may be a point of concern as well.

                      Sorry, but that is all I know right now. I will try to find out more. All I am really concerned about is whether she will have any options for appeal or re-filing if her application is denied.

                        last name not the same is not uncommon in the reat of the world. this does not seem to be the issue.

                        Why was she not included in the process?

                        Please get the facts and come back. It is the only way we could give you any accurate information. Anything else at this point would be speculation without facts

                            Normally, an alien has the right to appeal, but it is time sensitive and must be launched right away.
