I-797 validity date vs US consulate

If a petitioner has an H-1B approval from USCIS, but the I-797 petition validity date begins August 1 2004, could he apply his visa at the US consulate immediately, or must wait the petition validity date, or other date?

i dont remember exact timeframe, but i think:

in general
1. he can apply as soon as he gets approved 797
2. validity date of visa will start 10-30-60 days before validity date of 797.
U can check with attorney to make sure how long before 797 validity date he could enter us.
