  • Diff. between Notice Date and Receipt date

My employer has filed for I-140, I-485 on Dec -20-2004. Today i got EAC #s for I-765, I-131 and I-485. Each of the notice of action 797-C has 12/22/2004 as receipt date and 01/05/2005 as notice date. I am worried on 01/05 date as its after 31st Dec., which was deadline to file 140,485 to avoid new retrogession. Which date to count on ?received date or notice date?

    Thanks in advance

Receipt date is the date they received your application. That will be the date you will use to prove you filed before Dec 31st. The notice date is the date they printed up your I-797 Notice of Action.
