It seemed we have to go through a long separation after marriage . We've been doing the long distance for 2 years... and separation again after marriage doesnt sound too good... but thank you for all of ur advices....

That's right Aroha, I forgot the fiance visa using I-129F. It takes between 8-12 months too. ALl this timeline was before the increased application. NOw, it is just a matter of guess work how long anything will last. Surely we are dealing with USCIS

A K1 visa is for a fiancé, so if you marry first, you can't apply for that. What it does is gives your fiancé leave to come to the US for the purpose of marriage, which must happen within 3 months. After the marriage, you can adjust his status.

K3 is a spouse visa, so if you marry in Indonesia and come back to the US, that's what you'd have to apply for. Again, it's a non-immigrant visa and you'll have to adjust his status once in the US.

You have to send in the I130 application first, as the receipt for that is required to file 129F (the K visa application). You don't have to wait for the I130 to be approved, just received.

Anymore, it's not really that much faster than applying for CR1. You will still be looking at probably a year or longer. We had problems with ours, where they claimed not enough evidence etc, which was odd considering we applied for IR1 at the same time which went through with the exact same evidence.

Having him travel on a tourist visa is fraught with problems. For a start, he's immediately lying to immigration by stating that he has no intention to move to the US. It would most likely red flag him and put any applications at risk. I agree whole heartedly with Thoughtful on that though. If the USCIS didn't make us jump through so many hoops or force such lengthy separations, we wouldn't be trying to find ways around it.

Here is what I know for sure
1. If you get married in Indonesia, then he will have to remain in that country while you return and file a form I-130 (which will get him a visa in the IR-1 or CR-1 category). THis process takes about 8 - 12 months (because it is the US) in the absence of any problem.
2. After you have submitted a form I-130 for him, you can submit a form I-129F when you recieve form I-797 (receipt notice) from the USCIS. After the fee increase, form I-129F is now free. This second application will get him the K3 visa. THis application was supposed to be faster because it is a non-immigrant visa. BUt because we are dealing with USCIS, it maybe faster, the same or longer than the I-130. So it does not not hurt to turn it in. It just creates more work for the USCIS, and strangely the just made it free. But again, it is the USCIS here.
3. If he comes here on a tourist visa, and you get married and he stays, you can apply using form I-485 (adjustment of status). This is testing the waters with the USCIS and may turn out OK or may end up getitng him deported or something of that nature. I would not recommend it. But ofcourse if the USCIS processed things in a timely manner, people will not be thinking of how to circumvent the system.

Don't pay attention to this fool. He's been posting these type of remarks for several years and he sounds like a recording. Disregard him and keep posting. After you see several of his posts he won't sound as harsh as he does the first time. Don't let it affect you.

how utterly dumb can one be? Did you meet this 'marvelous' man via the internet? Did he promise you the moon? And no, tourist visas are for tourists (you know, people who just visit a country for a short period time and then go back to their own country...)..but if you doubt this, just have him tell our embassy officials what the true purpose of his visa request is....they will tell him what to do next.

We are planning to do the church ceremonial in his home country, and the civil ceremony in US. Which immigrant visa should I apply for him? Can I still apply K1 visa for him or K3? which one is the fastest? How long does it take for this type of visa to be issued? I also heard that I can apply CR-1 for him?
