  • Travel Document Vs. Visa stamp!!!!???

    I am currently in AOS from H-4 to GC. My passport has an expired visa stamp because I had filed my first H-4 extension in USA a few months back before I got eligible to file I-485 (AOS). Now I would like to travel to my country but I am not sure if I should apply with State Departement in Washington to get my current H-4 (which is still good until 2006) stamped or to apply for a Travel Document. Somebody told me I must file my application for H-4 visa along with my husband's application to get H-1. The problem here is that my husband is not eligible to get this benefit given that he has never gotten his H-1 stamped since he change status from visit visa in USA

    Does the AOS (I-485) void my previous status, in this case my H-4?

    What do you recommend?

      Once you have filed for AOS you must file for advance parole if you wish to travel.

        Does that mean my H-4 is no longer valid to go abroad?????

          what part of you MUST file for advance parole did you not understand??? You can't travel on your visa anymore.

            Just to clarify, people with on an H-1B status, or their dependents (i.e. H-4) may travel using their existing valid visas without AOS consequenses. However, people who do not have a valid visa in their passport would have to travel on Advance Parole.
