The Immigratiom has arrested my Husband on marrige fraud. My marrige is perfect but they denied my petion for him. He divorced this woman 8 months into the marrige never pursuing the green card,they are tring to deport him. We have a lawyer but I am tring to do everything in power to help him.He has a good work history and has no trouble with the law ever.Can anyone give me hope he will get out of this trouble or do I think the worse.

Please provide more details, such as how your husband came to US, did he file for any immigration benefits with his first wife? What petition did you file that was denied? From what I have read on this and other sites Immigration doesn't come looking for illegal immigrants. Was your husband arrested or pulled over for something else and then the police discovered his immigration status?
Whatever the answers might be, you need a good immigration attorney.

Thay came to my Husbands place of employment . They asked him to set up The Shiek at a Mosque when he told them he had no information on him they took his Id and asked him if he was tring to recieve a green card > he said yes. They told him they would make it easier if would help them . He said he has no info. they left. Then the shiek called cause he works for the same company and wanted him to deliver keys to him at the Mosque. he said he would accept the keys but he would not deliver them. then 5 minutes later they INS returned tried to give him another chance to set up the Shiek and he said he only knows about these keys once again they took his ID and told him they were going to make life hell for him if he did not give this guy up. Thay gave him a phone# if he changed his mind but it was missing 1 number. So called our lawyer and they said our papers were in order and not to worry. Then 6.5 hours later they came to our house and arrested him on Marrige fraud from his first marrige. He is just sitting in a city jail now they have not placed him in a Federal Dentention center yet so he can get before a judge for a bond hearing.WE have a good lawyer I hope but I just want to know if there is anything I find on paper to help my husband or any thing I am missing to get him out .They denied my petion for his residency so now how can he stay here. I want to amke sure I am getting the best legal help for case.I am so distraut over this I can not focus well . PLEASE HELP US >

If he entered on a studeent visa, he entered legally. Did he remain in school? When did he marry and when did he divorce? It may be that ICE thinks he married to stay in the country if no papers were ever filed for his first marriage and he didn't stay in school then he had no status. Even if that was the case, the marriage to you should put him in pending status. When did his marriage to you take place and when did you file I-130 and I-485? I assume these are the petitions that have been denied.
If USCIS denied your petition the letter should tell you why. Did it say suspected marriage fraud?
Was your husband in removal proceeding when you married?
I don't know why his marriage from 1998 would be an issue now. You said in your first post that they were trying to deport him. Do you think his first wife has reported him?
Maybe your husband just knows someone who has done something wrong and if he wasn't involved then surely his lawyer will prove he is innocenct and he'll be back home with you soon.

His marrige was 2000' and when he relized it was what he wanted he started the divorce from her.He attened school off and on thur his stay here.he only was married to her for 7 .5 months the divorce was final a few months after the papers were filed. ICE is tring to say that this woman he was married to was in marrige scam with a man from Algeria my was husband knows nothing of this. Ice says she was married too 8 differant men.She {1st wife ]did file papers for him but he did not go to or recieve anything fronm this 1st marrige. He went the demand registration that required for immigrants after 911 nothing was said to him then or after this point. We were married in April 05' we went to a lawyer for everything and he checked into his past case and he said it was inactive so the lawyer said that was good . BUt this ICE guy went digging ****her to see what he get on my husband to get him cause he did not help ICE. I am hoping for someone to tell they have these issues and everything had a good outcome. My husbands says either outcome is good cause God has a purpose for us here or in Morroco, we will just face it together. although USA is a better choice for all.The man ICE was looking for has turned himself in already and they have placed him already in a Federal Center and he is due for a bond hearing on wednesday but my husband is not getting granted this choice yet they just keep moving him from city jail to city jail. Sorry my typing is not good and I tend to go on but I am pulling at all strings to get advice.PLEASE

Best advice anyone here can give you --> FIND GOOD IMMIGRATION LAWYER ASAP!
This is nowhere near a normal situation due to the fact that ICE/DHS is involved, and the fact they're trying to enlist his cooperation to nail a bigger target. Since he refused them, he now has to pay the price of his lack of cooperation. You stated it yourself, they'll nitpick their way through until they can get to your husband. If this case can be brought in front of a IJ then you'll have better chance. But you'll want someone familiar with the immigration system to argue the case.
Did your husband complete the Special Registration though? That alone is enough to get him deported.

My husband had no info on him. Not even a phone #. He told them if had sopme info he would help them but he had nothing.The guy works for the same company anhd this Shiek married us with legal US marrige cert. All i know is he went and register for the special register after 911 we have reciept of this. They did fine him or deport him everything was good for him since then. My husband has no crimnal record and has worked at the same job for 4.5 years .does that way on any desicion the judge may have? I have asked the lawyer all these question too. I just want someone to tell the things he is doing are right or what I can demand him to more of.I DO THANK YOU VERY MUCH FOR YOUR SUPPORT.
