    Hello!I WILL BE HAPPY IF SOMEBODY GIVE ME GOOD ADVICE WHAT TO DO.I am US citizen,our 2 kids -green card holders and we received denial of i-601 4 days ago, because not enough supporting documents of hardship,my wife is guilty, 17 years ago, when she was divorced with me, she did show she was married with me in consulate and now she is out of status too. 485 was canceled too, but i-130 was approved 18 month ago.We don't know what to do know.Thanks

        Your story is somewhat confusing. You said you and your wife were divorced 17 years ago? Did you remarry her and now trying to adjust her status?

          we were remarried again in 1995 in NYC

            YES,we tried to adjust her status and was denied,because of misrepresentation and as i now,we need i-212 waiver.

              I am assuming if she was charged with misrepresentation that she was ordered deported? If so, when did she depart?

                she wasn't deported,she was in removal processing and the case was terminated because i-130 was approved and she was waiting for i-601 approval , the case was sent to immigration instead of court, after denying of i-601 she has to go back to the court and apply for i-212,i have no idea what for what is next

                  Immigrate2us.net has numerous hardship letters you can look through to get some ideas. Not to suggest plagarism, but sometimes reading hardships of others may trigger additional ones which may exist in your situation.

                  You should discuss this with a reputable immigration attorney. Good luck to you and your family!

                    OK, so let's get this straight - your wife originally claimed an immigration benefit on the basis of your marriage when in fact you were no longer married?

                    For this, you definitely need the I-212 waiver to get past the misrepresentation. More than that, you need a reputable immigration attorney. One is always recommended in cases where waivers are necessary and your case is more complicated than most. I wouldn't recommend trying this on your own.
