Help! My Illegal criminal ex-husband has more rights than me!!!

  • Help! My Illegal criminal ex-husband has more rights than me!!!

    I got married in a moment of insanity. I put it that way, to a man that is here with a tourist visa. When we got married he never applied for residence. Right after, he started abusing me and managed in 2 ocassions to convinced police officers that he was the victim. Which I am taking care of to clear that with 2 cities. He had committed: DV, Bigamy, Identity theft, tax fraud, tampered court papers, etc. This man moved from city to city and end up in Tucson filing for divorce. After loosing all I worked forso long, obviously it s very hard for me but not imposible!! Now, he has pevented me to attend court and file papers, which anyways I did! On he trial date, that I was unable to attend because someone put water in the oil of the car??? The judge let me here it by phone. Obviously I could not present all the evidence that I had. My question is: He said that he got arrested in Florence to be deported and someone paid a bond of $7000. Now he has a court date set for the end of May. How can I provide the Immigration court with ALL the evidence that I have, so he goes to jail and deported?? I will not give up, eventhough I have to live evryday watching my back and my kids. If anybody can help me and advice I would greatly appreciated for life. Thanks

        That's what happens when you think with your libido instead of your brain. Nothing but pay the consequences for getting in bed with a con artist. Get a good lawyer or hire a thug to take care of your trouble...

          Unfortunately Matrix, yes I admit that I made a big mistake and I am paying the consequences at a very high price. Regardless of the situation, I think that your comment was definately out of line. If you are not going to give a good advice or suggestion, do not make us people that really need advice waist our time with inmature comments like this!

              life is not always fair Viviana. It's hard to face reality when the truth hurts. I'm only commenting on your actions ---you are not the only one, I'm sure there are many others out there with similar issues. Like I said, get yourself a good lawyer

                Has this person been convicted of any of those crimes you mentioned? Evidence on your side alone is not going to help, specially if you're divorcing.
                If there's no convictions, there's not much you can do. If he has re-married, then chances are the judge will allow AOS based upon the marriage. I understand you're trying to establish marriage fraud, but the way it works, you will be held responsible as well. If you married this guy in a moment of insanity or under the influence it does not matter, it only matters when you marry the person KNOWING you're committing a crime, to evade immigration law and FOR NO OTHER REASON.
                Immigration court is not the place to seek revenge, sorry to say but it's the law. You should try and contact both a family law attorney and an immigration attorney to see what you can really do from a legal point of view. This is not legal advice.

                  Even though I don't have any legal advice on the problem, you can have my sympathy.
                  I've been going through something similar in my life, except that I'm the immigrant and there was no children from the marriage.
                  My soon to be ex-husband has done pretty much the same things your husband did, except that he was never caught for any of his immoral and/or illegal deads.
                  I applied for divorce and could only make him leave my place through a court order.
                  He took all the marriage assets(to which I was entitled to half)even before the final trial and threatens to make me pay for his expenses if I claim anything in court.
                  I live a humble and honest life and cannot afford a lawyer. Besides that, my immigration status may be jeopardized because of the divorce. Still, I decided to take the risk, than staying married to him.
                  Besides that, I know how difficult it is to get material evidence, mainly because when you marry a person, the last thing you worry about is divorce or gathering evidences against the person, not to mention, ending up in a letigious divorce.
                  Hope you can find a way to solve your problem.
                  Don't loose your faith. Revenge is something that only makes us sour and unhappy.

                    Hello everyone!

                    I am new here and reading with interest what you all have to say. I was wondering, is this forum only for people concerned and or affected with immigration problems, or are there lawyers and/or legal respresentation in here that would be able to comment?

                        YOU ARE RIGHT HOUSTON! REVENGE IS NOT WHAT I AM LOOKING FOR BECAUSE IT DOES NOT LEAD YOU TO ANYTHING. CONSIDERING THE FACT THAT THE MARRIAGE WAS ANNULED BECAUSE 2 THINGS, HE HAD ANOTHER IDENTITY AND HE ADMITTED IN COURT THAT HE WAS STILL MARRIED IN HIS COUNTRY (BYGAMY). CORRECT ME IF I AM WRONG BUT, I KNOW THAT AZ IS A STATE OF NO FAULTM BUT YOU HAVE TO ENTER A MARRIAGE IN GOOD FAITH AND BYGAMY WOULD BE BREAKING IMMIGRATION LAWS. I KNOW THAT HE WILL GET CAUGHT SOONER OR LATER, I HAVE SOLID EVIDENCE OF HIS SKILLED CRIMES (TAX RECORDS, FAKE ID, MEDICAL RECORDS, PICTURES OF ABUSE YOU NAME IT, POLICE RECORDS ETC) I HAVE ALMOST 3 BOXES OF PAPERWORK THAT I HAVE COLLECTED, STUDIED, RESEARCH. YES, IF I GO TO COURT HE GOES TO JAIL AND PAY FOR ALL HE DID TO A LOT OF PEOPLE SO I FEEL THAT IS MY RESPONSIBILITY TO DO IT. IT IS VERY HARD TO BE IN THIS SITUATION, KNOWING THAT YOU HAVEN'T DON'T ANYTHING BUT THEN AGAIN HAVE TO MAKE THE DECISION OF SENDING SOMEONE TO JAIL. WHO AM I TO JUDGE?? NOBODY.
