      A misrepresentation is material if it has a natural tendency to influence the decision. This very concept associates the misrepresentation with the procurement of a benefit.
      Thus, for purposes of determining the natural tendency of a misrepresentation to affect a decision, what is relevant is what would have ensued from official knowledge of the misrepresented fact.

                  did he have a conditional card first?
                  If not, the 10-yr card suggests that you were interviewed after being married 2 years, which would mean the interview occurred after May 2005, yet you were already separated?

                      So, in summary someone can be in deportation proceedings, get married for a short period of time and then be rewarded with a 10 year green card for their troubles. This does not include the other financial benefits said individual obtained from the spouse.

                      Its enough to make a bleeding heart ask for a bandage.

                            Obtaining LPR status is not the end of the story. This is a number of options available to CIS when they detect some form of fraud. Either they actively move to strip the alien of LPR status based upon the discoveries or they patiently wait until the alien decides to apply for citizenship, and confront the alien with the evidence related to the fraud. Then the a number of procedures may be initiated.
