Marriage to a Green Card Holder

My son is a resident alien and he is eligible to apply for his Citizen in May this year. His fiance is in the United States on B2 Visa which will expire in February.

What is the best way to keep his fiance here till he becomes citizen.

If they marry now and he sponsors her, will that work for her to stay here.
In case, she overstays after their marriage and sponsorship.
Any comments will be appreciated.

She can apply for an extension. But when they marry, USCIS will investigate her past immigration applications and will review the extension application and observe that she lied, she will be extending in order to marry. Then she will be denied and placed in deportation proceedings.

Why don't your son and his fiance do what is legally correct and honorable??

Your son's fiance was admitted to America as a tourist, and accepted the terms of her admission to the country. I'm sure that she neglected to advise the immigration officer that she was also the fiance of a permanent resident!!

Your son's fiance should go home as she agreed to do.

If your son doesn't respect America enough to abide by its laws and rules, then he doesn't deserve to become a citizen...indeed, he doesn't even deserve to be a permanent resident.

My son and me we all respect American Laws and are proud of it.
She is already planning to go back and when my son becomes citizen then they can marry and bring her over here.
I was just exploring any legal possibilities to avoid her going back.

Y should he wait until he becomes a citizen? let him go back with her marry her over there and start the process now. his becoming a citizen is a win, win. Think man, think!

You will only complicate matters if they marry here. Better to be safe than sorry my friend.
