Hi all...what happends if the case is at Homeland secu. office? one friend of mine has filed for 1-485 (adjustment status thru his mom)and was told that the case is at the miss. office. though the processing date has already passed meaning he shuld've got the gc as of yet but he hasn't. He was in a fight as a teenager few yrs back where he was found guilty but later got the expongment ( i hope i'm spellin git rite)and lawyers said it won't be a problem . so my question is that what r the risks and chances for him? please ask if q's is not clear but do HELP! thanx a lot!

well regarding processing, i dunno. If he was sentenced as a juvenile/youth, there is no problem, check Matter of Devison.Comment

the BIA case regarding juveniles, his attorney must know. Never expunge a record before becoming a USC. Unless is an expungement of conviction. Make sure he was adjudicated a juvenile and not as an adult.Comment

thanx guys...wut if he was convicted as an adult? His lawyer said that there are lots of other cases which been held up due to felonies and street fights..he says that we shuld make an appt in Missouri and ask them personally...has anyone on this forum gone there b4 and if they did wut happend? wut r the chances?Comment
