EAD NOA never received

Hi,

My husband and I filed his 485 packet and 765 forms together in November 2004. We received the NOA for I-130 and I-485, but had to resubmit 765 because we forgot to check a box.

We have still not received the NOA for the I-765. On the 31st day of not receiving it, we called the customer service line and were transferred to an immigration officer who read off our address which is correct and said that the noa was returned as undeliverable and we don't know why. He gave me the receipt number and said he would file something to get another copy sent to us.

It has been 10 days and still no NOA. I have added the receipt number to my portfolio on the uscis website and when I click on it to check status it says "was sent back as undeliverable."

I do not have a receipt date as one is not listed on the website and I haven't received the new copy of the NOA yet.

Are they still processing my form even though the NOA was returned? If I call and get a receipt date on the NOA from cutomer service line, can we get his interim EAD at the 91st day even if we still haven't received the NOA?

12/6/04: Sent new 765 and payment to new address in Chicago
12/15/04: I-765 Money Order Cashed - haven't received NOA
12/23/04: Biometrics for 485
12/23/04: I-485 touched
12/29/04: Results of fingerprint review received (e-mail update)
1/10/05: Called USCIS Customer Service and spoke to immigration officer - informed 765 was returned as undeliverable by Post Office on 12/21/04 even though the address was correct. Officer gave receipt number and said he would file for a copy of NOA to be sent.
