That was never my understanding and I agree it could be misconstrued that way. But if explained, no one I think would ever deny in state tuition for a US Citizen of that state.
IMBRA is the International Marriage Brokers Regulation Act which attempts to prohibit international love.

"In-State" Tuition for Children of Aliens..(right thing to do)

Well if you follow the link, the problem legislatively was the child was tied to the parents location.
And all the "hype" on talk radio refers to "children of illegal aliens" getting in-state tuition, without mentioning the part about the child being a US Citizen.
Cleverly the "attack ads" by anti_immigrants say something like this, "joe Politican voted to give children of illegal aliens in-state tuition".
I think most of the legislation aimed at 'fixing" this as much as it could be fixed even for children who were not US Citizens, was for kids who had spent the four previous years in a High School in the same state.

You misunderstand the issue. No one questions a USC child from getting in state tuition. The issue is for children who are also illegal from getting this benefit while out of state USC's have to pay double.

1. The child is a US Citizen
2. The child is at NO FAULT for his parents bringing him here.
3. The child is a citizen of the state he lives in and should not have to pay "out of state tution" because his parents no longer have access to the US.
4. Its HUMANE, its recognition of reality and it is the RIGHT THING to do.
5. It is appropriate to punish the person who broke the law not a close relative.
