J-1 to waiver to H-1 to Green card family based

    Hello All:
    I was a J-1 physician and received my waiver in July 2004. I am on a H-1 with my employer for 3 yrs till June 2007. I am married to a US citizen in Jan 2003. I was told that as soon as I get the waiver apply for a I-130 and concurrently apply for I-485 adjustment of status since this will take time for processing.
    Is this correct or should I wait? What if my adjustment of status arrives before June 2007.

      You shouldn't wait to file.
      You can continue using your H-1 visa while you're case is pending for your adjustment of status. When you are granted adjustement of status this will cancel out the H-1 visa and you will be able to continue working as a permanent resident.
