I lived in Kenya for two and one half years until two months ago and married my wife last november after knowing her for two years. Our I-130 petition was approved, but our visa was denied after our interview on grounds of misrepresentation. The interviewer felt that misrepresentation or fraud had occured, since my wife had a finacee visa applied for in June of 2004 by a previous boyfriend that left Kenya in 2002. Although, this visa was not applied for with her complete consent. After not marrying my wife, the previous boyfriend attmepted a relationship with my wife's mother and eventually married her sister. Currently, he is chasing after another woman in Nairobi. He has stalked my wife and recently, threatened to kill himself and my wife.
What do I need to do to appeal the denial of the visa? What forms need to be filed and where do these forms need to be filed? What are the chances of the appeal being approved?
