  • divorce after receiving LPR

    I received my LPR nearly 3 years ago (sept 2001) by way of marriage to a US citizen. I separated from my wife (who is the USC I married), and have begun divorce proceedings on the grounds of abandonment. If I (the LPR receipient), commences the divorce proceedings, will the INS or BCIS find out about my divorce? and if so, does that jeopardize my LPR? Please help

    Hi David

    When you got married you most likely recieved a conditional green card good for 2yrs. Form 751 had to be filed jointly to remove the conditonal status. this would have given you a greencard good for the 10yrs and you would be Legal permanent resident for that time period.

    Did you remove the conditions with the form?

    if yes... then it doesnt matter to UScis.

    If no the conditons wer not removed.. will advise based on your respnse. it will matter.

        Actually, when I received my LPR, it was not the conditional one. I received the unconditional one since i had been married for almost 4 years when I was called for my spousal interview. Therefore, when I was granted my green card, it had no conditions on it.

          Then you are in the clear... unless it was a sham marriage and your ex can prove it, then Immigration can revoke your LPR status, but if not, don't worry.

            Hi David

            AS old man has told you.. you are fine. Get your divorce. Make sure you have all the documentation in order when you go to apply for citizenship when the time comes. Keep your nose clean until then . Good luck

              it's funny. there are actually people who file divorce papers the VERY next day the conditions are approved. I kid you not!

                Divorce wont have any impact whatsoever on your GC ....
