One jury convicts brothers of assault on firefighter; second jury continues deliberations.
A Suffolk County jury has convicted twin brothers of first-degree gang assault and first-degree assault for the September 2006 beating of a New York firefighter.
Darian and Darrell Taylor face a maximum prison sentence of ten to 25 years when they are sentenced January 8. Deliberations began Monday, December 3. The trial started November 13.
The second jury reviewing the evidence against Christopher Robinson, 29, the half-brother of the Taylors, began deliberations Tuesday and resume tomorrow (Thursday) morning.
Police said the trio attacked Richard Berkhout, 47, of Mastic Beach, during a confrontation on a residential street on the evening of September 11, 2006. Berkhout was walking with his wife on Lakeview Drive near Elm Street in Mastic Beach when the assault occurred. Berkhout was severely beaten for several minutes and suffered a fractured skull, broken teeth and a permanent loss of hearing in his right ear.

Suffolk Law Enforcement and Marshal's Fugitive Task Force apprehend 64 in weeklong sweep
A five-day multi-jurisdictional fugitive sweep by the US Marshal's Regional Fugitive Task Force and fifteen law enforcement agencies resulted in the arrest of 64 men and women for various felony crimes including second degree murder, criminal sale and possession of drugs and armed robbery.
Suffolk District Attorney Thomas Spota, US Marshal for the Eastern District Eugene Corcoran, Police Commissioner Richard Dormer and Sheriff Vincent DeMarco today announced the arrests made November 26 through November 30 during Operation Rolling Thunder.
**Among the violent felons brought to justice: Thomas Walker, 20, of 75 Homestead Drive in Coram, a member of the Bloods street gang who police say is a member of a violent crew that committed five home invasion robberies in the town of Brookhaven this past summer.
During an East Moriches burglary, the female homeowner was struck in the face with a hammer, inflicting a wound that took 80 stitches to close. Walker's codefendants told police it was Walker who beat the woman.
Walker is a prior felony offender, convicted of a 2004 burglary in Brentwood. He is incarcerated today in Waterbury, Connecticut and will be extradited this week.
District Attorney Spota said 77 felony warrants and six misdemeanor warrants were cleared during the five-day sweep. 23 of the defendants picked up by law enforcement face drug charges, 22 violated the terms of their probation, 14 are parole violators, and six were being sought for assault charges.
Arrested on an indictment warrant during the sweep was Christopher Marinus, 20, of Port Jefferson Station, the second man sought by police since the brutal assault in May of this year of Kevin Combs outside a Port Jefferson pub. Two men kicked and punched Combs and left the victim bloodied and unconscious in the street.
Police arrested Marinus' codefendant, Michael Pekrul of Miller Place, in July for the assault. Marinus was arraigned December 3 on the grand jury indictment. He is charged with first and second-degree assault and first and second-degree robbery charges.
Another defendant arrested in the Rolling Thunder initiative, Eleno Morales, was apprehended in South Carolina and arraigned in first district court in Central Islip today. Morales pleaded not guilty to one charge of second-degree murder. He allegedly shot 32-year-old Lazo Mauricio to death on November 20, 1996 in the victim's Brentwood home.
District Attorney Spota said the cooperation between the Marshal's office and local law enforcement, and the effectiveness of the Regional Fugitive Task Force, has resulted in the apprehension of 1,129 fugitives since 2002.
"The brave men and women under Gene Corcoran's leadership find the toughest fugitives, criminals who are prior violent felony offenders with extensive criminal records for drug dealing, *** crimes, violent assaults and armed robberies," Spota said. "The fugitive task force, the district attorney's squad and fifteen local law enforcement agencies worked together to bring these 64 defendants to justice."
US Marshal Eugene Corcoran said "Operation Rolling Thunder personifies the cooperation the Marshal's service has in Suffolk County with local police and District Attorney Spota's office, a working relationship that shows when we pool our resources, we can successfully apprehend fugitives here and outside Suffolk, as is the case here with the arrests of fugitives in South Carolina and Connecticut."

21-year-old Michael Pagan, 19-year-old Cynthonia Shewprashad, 18-year-old Emmanuel Thompson, and 19-year-old Cal Daniels, all of Ridge, were charged one count of first-degree assault and ten counts of first-degree burglary. Defendant Emmanuel Thompson is charged additionally with one count of first-degree sexual abuse, a crime allegedly committed against a female victim during a burglary in East Moriches on June 19. Michael Pagan, Shewprashad, Thompson, and Daniels were arrested on 6/21/07.
Shewprashad pleaded guilty November 7 to two counts of first-degree burglary and will testify against her codefendants.

Arraignment Friday in Riverhead for Queens man charged with *** abuse of girl
A Queens man arrested two months ago at his east end home for allegedly molesting and assaulting a 12 year old female will be arraigned on a grand jury indictment Friday, November 30.
Suffolk County District Attorney Thomas Spota said Michael Rich, 71, of Forest Hills Gardens, Queens, was initially charged with sexual abuse in the first degree, a felony, two misdemeanor counts of sexual abuse in the second degree and endangering the welfare of a child. The defendant allegedly molested the child victim on August 16 of this year.
Southampton Village Police arrested Rich on September 29 at his Lake Agawam shoreline home. He is free on $10,000 cash bail.
Suffolk County Judge Barbara Kahn will unseal the indictment.
The court calendar starts at 9:30 am.

Jury selection scheduled to begin for a former Huntington town building department employee was canceled this morning when she decided to plead guilty to the indictment charging her with stealing approximately $70,000 in town permit revenue.
Suzette Pinckney-Black, 47, will be sentenced January 29, 2008 by Suffolk County Judge Ralph G***illo.
Her defense attorney, John Shea, negotiated the terms of the defendant's sentence with the court.
If Ms. Black returns $10,000 on the sentencing date, she will be sentenced to four months jail and five years probation. If she returns $30,000, she will be sentenced to five years probation. In either scenario, Pinckney-Black will be required to pay restitution during her probation equal to the amount stolen from the town, an estimated $68,000.
If the defendant is unable to return any money to Huntington town coffers on January 29, she will be sentenced to one year in jail. In that event, the district attorney's office will seek a civil judgment order from the defendant for the amount stolen from the building department.
The district attorney's office will make a sentencing recommendation that includes jail time no matter how much restitution the defendant provides on the day of sentencing. Ms. Pinckney-Black, who pled guilty to second-degree grand larceny, delayed deposit of checks and altered town financial records to mask her larceny over a four-year period (2002-2006).

Jury convicts Nesconset man of kidnapping for 2006 abduction of young girl
A Suffolk County jury today convicted a Nesconset man charged with snatching a young girl from her bicycle in Hauppauge and forcing her into his car last year. Michael Burkhardt, 31, covered the ten-year old's mouth and eyes with duct tape, drove a couple of blocks, and freed the youngster, who ran to a nearby house and called the police. The girl identified Burkhardt four days later in a police lineup. After approximately two and one-half hours of deliberations this afternoon, the jury convicted the self-employed computer technician of second degree kidnapping and endangering the welfare of a child. Sentencing is scheduled for December 18. Second-degree kidnapping is a class B felony, punishable by a maximum of five to 25 years in prison.

SYRACUSE -- Two New York State parole officers pumping gas at a local gas station caught a man with crack cocaine after smelling an odor. It happened at the Mobil on 621 South Geddes Street at 11:20 am Friday. They smelled a strong odor of burning marijuana wafting in the air. Glancing around they spotted a male sitting in a van smoking a "blunt". When the officers approached the van and identified themselves, the male quickly threw an object to the floor of the vehicle, which later turned out to be approximately four grams of crack cocaine. Syracuse Police Officers were called to the scene to assist and the male, Jamar Green (18 yrs) of 1318 South Avenue was arrested and charged with Criminal Possession of Controlled Substance in the 3rd (felony) and 7th (misdemeanor) as well as Criminal Possession of Marijuana 5th (misdemeanor).

CICERO -- An honor roll student at Cicero-North Syracuse High School has been charged with distributing photos that underage female students took of themselves naked, authorities said.
The images showed nine girls between the ages of 11 and 14 posing without clothes in various homes and were taken from two to three years ago, Onondaga County Assistant District Attorney Gary Dawson said Friday. No sexual acts were shown.
Simply possessing the images shot by the girls did not break any laws, Dawson said, so Michael Wixson, 17, of North Syracuse, was charged after he sent the photos over the Internet to a 15-year-old girl.
Wixson, a student at C-NS, was arraigned Thursday on a felony charge of disseminating indecent materials to minors and a misdemeanor count of endangering the welfare of a child.
He was released without bail while prosecutors present his case to a grand jury. The felony charge against Wixson is punishable by up to four years in prison.
Robert Wells, Wixson's attorney, did not immediately return phone calls seeking comment.
Authorities were continuing their investigation, but Dawson declined to say whether any others would be charged.
Dawson said many of the images were taken independently over a period of time, and he didn't know how they all ended up in one package.
The girls took the photos using digital and cell phone cameras and sent the naked pictures to their boyfriends at the time. Investigators were able to identify eight of the nine girls shown in the pictures, Dawson said.
North Syracuse Superintendent Jerome Melvin said school officials first became aware of the pictures in June 2006 when a student at the junior high school bought a DVD with the 12 images for $5. The district traced the disc to two other students, and all three were suspended, Melvin said. Wixson was not one of the students, he said.
Melvin said he thought the matter was settled.
A criminal investigation started six months ago after the images appeared on social networking and photo sites, such as MySpace and flickr.com, Dawson said. The images were bundled under the title: "Girls Gone Wild at C-NS."
"If this isn't a wakeup call, I want to know what is. ... I don't think young people realize the seriousness of all this," Melvin said.
Dawson had been at the high school just last week to give students a presentation on cyber safety and security, Melvin said.
District Attorney William Fitzpatrick said what he found disturbing was how the girls - some as young as 11 - could so easily snap salacious pictures and feel comfortable messaging them to teenage boys.
"When you take that picture and you think you sent it to someone, you could have sent it to most of the civilized world," Fitzpatrick said.

Grandmother sentenced for grandson's death

CANANDAIGUA -- A western New York woman was sentenced Wednesday to five to 15 years in prison for killing her infant grandson.
Barbara Hershey was convicted in October of second-degree manslaughter for the death of four-month-old Ethan Hershey.
Authorities in Ontario County say the 67-year-old woman violently shook the child while baby-sitting for him at her home in Gorham. Ethan died from his injuries two weeks after the October 2005 incident.

Syracuse Police have arrested the man who robbed the Alliance Bank on James Street Monday morning.
Police tell us John Mulligan, 53, tell us they arrested Mulligan after the public's help. Many people called in tips to Syracuse Police on the identity of the suspect.
During the robbery, Mulligan approached the teller inside Alliance Bank at 1001 James Street and handed her a note saying that he had a gun and he would shoot her if she did not give him the money.
Mulligan admitted to the robbery and that he already spent the money that he took. He is charged with third degree robbery. He is scheduled to be arraigned in Syracuse City Court tomorrow.

Mike Tyson might be familiar with a prison uniform, but what he's not had to endure, until now, is the addition of pink underwear, pink socks, and pink handcuffs. Sheriff Joe Arpaio forced the former heavyweight boxing champ to don the pink attire because he believes that pink has a calming effect.
Tyson was jailed for one day after admitting to charges of possessing cocaine and driving under the influence. He reported yesterday to Tent City, an infamous open-air jail set up near a dog pound and a garbage dump. In addition to the one day in prison, Tyson was also slapped with 360 hours of community service. Tyson, 41, was arrested last Christmas in his BMW after leaving a nightclub.
Having spent only a day in the jail, Tyson narrowly escaped another favorite punishment of Sheriff Arpaio- the chain gang.

Archbishop Earl Paul at the Chapel Hill Harvester Church located just outside Atlanta is at the center of a new *** scandal set to rock the megachurch. Paulk's family stood in front of their parish a few Sundays ago and revealed his dirty secret: their 80-year-old leader had years earlier slept with his brother's wife and fathered a child by her.
The secret was exposed by a recent court-ordered paternity test, and although this is not Paulk or the church's first brush with scandal, Paulk could find himself in trouble with the law this time for lying under oath about the affair.
Proof of the affair and lie is Paulk's 34-year-old son, D.E. Paulk, who was known for years publicly as his nephew. D.E. Paulk said that he did not know that Earl Paulk was his father until the paternity test: "I was disappointed, and I was surprised," he said.
Earl Paulk was ordered to take the paternity test at the request of the Cobb County district attorney's office and the Georgia Bureau of Investigation. Both agencies are currently investigating Earl Paulk for potential perjury and false-swearing charges that stem from a lawsuit

Barry Bonds was indicted Thursday by a federal grand jury on charges of perjury and obstruction of justice.
The five-count indictment includes four counts of perjury and one of obstruction of justice. This case marks one of the longest federal grand jury investigations in Northern California history. The case has introduced the world to the acronym BALCO, which stands for Bay Area Laboratory Co-Operative, which led to the downfall of several American professional athletes, including Olympic champions Marion Jones, Tim Montgomery, and Kelli White. Several current and former NFL players were called to testify in the case, and the put the spotlight on Major League Baseball and their problems with performance-enhancing drugs once again.
The charges for which Bonds was indicted today stem from his December 4, 2003 testimony where he allegedly testified that he did not knowingly take any performance enhancing drugs.
Barry Bonds trainer, Greg Anderson, was convicted in the BALCO case on grand jury charges, and served time in jail. He returned to prison when he refused to testify against bonds, and remains in jail to this day.

OJ Simpson faces life in prison for kidnapping in the bizarre hotel room robbery. November 28th is the next time Simpson and his accomplices will appear in Las Vegas courtroom. The former Buffalo Bills running back now faces 11 Felony counts and one misdemeanor.
Some legal experts believe that it will hard to have all charges stick and that a plea bargain will be arranged between the prosecution and defense.
The big event that occurred today is the fact he has the chance to be behind bars for the rest of his life for the kidnapping charge, which many thought would be tossed out due to lack of evidence.

JACKSONVILLE, Fla. -- A corrections officer with the Jacksonville Sheriff's Office was arrested on driving under the influence and other charges after a single-vehicle wreck on Interstate 295 early Sunday.
According to the arrest report, Officer Scott Perry was in uniform when the Florida Highway Patrol arrived at the scene of the wreck on I-295 at the New Kings Road exit about 12:30 a.m.
Perry, 30, told a trooper he lost control of his Dodge Durango while reaching for a cheeseburger. The FHP said Perry was unsteady and appeared impaired and his eyes were bloodshot and glassy.
The FHP said Perry consented to a field sobriety test, which he failed. Troopers also reported finding codeine, Demerol and Xanexl painkillers in his possession for which he had no prescription.
Perry told the arresting officer he was holding the drugs for his brother.
Perry was arrested on charges of DUI, armed possession of illegal drugs and drug possession. He was being held on $27,000 bond.

Just thought I would give a few crimes equal play time. I thought this forum was to help people with immigration problems. I didn't know it was a place to rant and rave about illegals. All I seem to find is comments and news reports about crimes involving illegals. I fail to see what those crimes have to do with people discussing the immigration process. So, I thought that I would remind people about other crimes that might not involve illegals. I am not sure about some of these people after all they committed crimes, they might be illegal.

Jury convicts Nesconset man of kidnapping for 2006 abduction of young girl
A Suffolk County jury today convicted a Nesconset man charged with snatching a young girl from her bicycle in Hauppauge and forcing her into his car last year. Michael Burkhardt, 31, covered the ten-year old's mouth and eyes with duct tape, drove a couple of blocks, and freed the youngster, who ran to a nearby house and called the police. The girl identified Burkhardt four days later in a police lineup. After approximately two and one-half hours of deliberations this afternoon, the jury convicted the self-employed computer technician of second degree kidnapping and endangering the welfare of a child. Sentencing is scheduled for December 18. Second-degree kidnapping is a class B felony, punishable by a maximum of five to 25 years in prison.

SYRACUSE -- Two New York State parole officers pumping gas at a local gas station caught a man with crack cocaine after smelling an odor. It happened at the Mobil on 621 South Geddes Street at 11:20 am Friday. They smelled a strong odor of burning marijuana wafting in the air. Glancing around they spotted a male sitting in a van smoking a "blunt". When the officers approached the van and identified themselves, the male quickly threw an object to the floor of the vehicle, which later turned out to be approximately four grams of crack cocaine. Syracuse Police Officers were called to the scene to assist and the male, Jamar Green (18 yrs) of 1318 South Avenue was arrested and charged with Criminal Possession of Controlled Substance in the 3rd (felony) and 7th (misdemeanor) as well as Criminal Possession of Marijuana 5th (misdemeanor).

CICERO -- An honor roll student at Cicero-North Syracuse High School has been charged with distributing photos that underage female students took of themselves naked, authorities said.
The images showed nine girls between the ages of 11 and 14 posing without clothes in various homes and were taken from two to three years ago, Onondaga County Assistant District Attorney Gary Dawson said Friday. No sexual acts were shown.
Simply possessing the images shot by the girls did not break any laws, Dawson said, so Michael Wixson, 17, of North Syracuse, was charged after he sent the photos over the Internet to a 15-year-old girl.
Wixson, a student at C-NS, was arraigned Thursday on a felony charge of disseminating indecent materials to minors and a misdemeanor count of endangering the welfare of a child.
He was released without bail while prosecutors present his case to a grand jury. The felony charge against Wixson is punishable by up to four years in prison.
Robert Wells, Wixson's attorney, did not immediately return phone calls seeking comment.
Authorities were continuing their investigation, but Dawson declined to say whether any others would be charged.
Dawson said many of the images were taken independently over a period of time, and he didn't know how they all ended up in one package.
The girls took the photos using digital and cell phone cameras and sent the naked pictures to their boyfriends at the time. Investigators were able to identify eight of the nine girls shown in the pictures, Dawson said.
North Syracuse Superintendent Jerome Melvin said school officials first became aware of the pictures in June 2006 when a student at the junior high school bought a DVD with the 12 images for $5. The district traced the disc to two other students, and all three were suspended, Melvin said. Wixson was not one of the students, he said.
Melvin said he thought the matter was settled.
A criminal investigation started six months ago after the images appeared on social networking and photo sites, such as MySpace and flickr.com, Dawson said. The images were bundled under the title: "Girls Gone Wild at C-NS."
"If this isn't a wakeup call, I want to know what is. ... I don't think young people realize the seriousness of all this," Melvin said.
Dawson had been at the high school just last week to give students a presentation on cyber safety and security, Melvin said.
District Attorney William Fitzpatrick said what he found disturbing was how the girls - some as young as 11 - could so easily snap salacious pictures and feel comfortable messaging them to teenage boys.
"When you take that picture and you think you sent it to someone, you could have sent it to most of the civilized world," Fitzpatrick said.

Grandmother sentenced for grandson's death

CANANDAIGUA -- A western New York woman was sentenced Wednesday to five to 15 years in prison for killing her infant grandson.
Barbara Hershey was convicted in October of second-degree manslaughter for the death of four-month-old Ethan Hershey.
Authorities in Ontario County say the 67-year-old woman violently shook the child while baby-sitting for him at her home in Gorham. Ethan died from his injuries two weeks after the October 2005 incident.

Syracuse Police have arrested the man who robbed the Alliance Bank on James Street Monday morning.
Police tell us John Mulligan, 53, tell us they arrested Mulligan after the public's help. Many people called in tips to Syracuse Police on the identity of the suspect.
During the robbery, Mulligan approached the teller inside Alliance Bank at 1001 James Street and handed her a note saying that he had a gun and he would shoot her if she did not give him the money.
Mulligan admitted to the robbery and that he already spent the money that he took. He is charged with third degree robbery. He is scheduled to be arraigned in Syracuse City Court tomorrow.

Mike Tyson might be familiar with a prison uniform, but what he's not had to endure, until now, is the addition of pink underwear, pink socks, and pink handcuffs. Sheriff Joe Arpaio forced the former heavyweight boxing champ to don the pink attire because he believes that pink has a calming effect.
Tyson was jailed for one day after admitting to charges of possessing cocaine and driving under the influence. He reported yesterday to Tent City, an infamous open-air jail set up near a dog pound and a garbage dump. In addition to the one day in prison, Tyson was also slapped with 360 hours of community service. Tyson, 41, was arrested last Christmas in his BMW after leaving a nightclub.
Having spent only a day in the jail, Tyson narrowly escaped another favorite punishment of Sheriff Arpaio- the chain gang.

Archbishop Earl Paul at the Chapel Hill Harvester Church located just outside Atlanta is at the center of a new *** scandal set to rock the megachurch. Paulk's family stood in front of their parish a few Sundays ago and revealed his dirty secret: their 80-year-old leader had years earlier slept with his brother's wife and fathered a child by her.
The secret was exposed by a recent court-ordered paternity test, and although this is not Paulk or the church's first brush with scandal, Paulk could find himself in trouble with the law this time for lying under oath about the affair.
Proof of the affair and lie is Paulk's 34-year-old son, D.E. Paulk, who was known for years publicly as his nephew. D.E. Paulk said that he did not know that Earl Paulk was his father until the paternity test: "I was disappointed, and I was surprised," he said.
Earl Paulk was ordered to take the paternity test at the request of the Cobb County district attorney's office and the Georgia Bureau of Investigation. Both agencies are currently investigating Earl Paulk for potential perjury and false-swearing charges that stem from a lawsuit

Barry Bonds was indicted Thursday by a federal grand jury on charges of perjury and obstruction of justice.
The five-count indictment includes four counts of perjury and one of obstruction of justice. This case marks one of the longest federal grand jury investigations in Northern California history. The case has introduced the world to the acronym BALCO, which stands for Bay Area Laboratory Co-Operative, which led to the downfall of several American professional athletes, including Olympic champions Marion Jones, Tim Montgomery, and Kelli White. Several current and former NFL players were called to testify in the case, and the put the spotlight on Major League Baseball and their problems with performance-enhancing drugs once again.
The charges for which Bonds was indicted today stem from his December 4, 2003 testimony where he allegedly testified that he did not knowingly take any performance enhancing drugs.
Barry Bonds trainer, Greg Anderson, was convicted in the BALCO case on grand jury charges, and served time in jail. He returned to prison when he refused to testify against bonds, and remains in jail to this day.

OJ Simpson faces life in prison for kidnapping in the bizarre hotel room robbery. November 28th is the next time Simpson and his accomplices will appear in Las Vegas courtroom. The former Buffalo Bills running back now faces 11 Felony counts and one misdemeanor.
Some legal experts believe that it will hard to have all charges stick and that a plea bargain will be arranged between the prosecution and defense.
The big event that occurred today is the fact he has the chance to be behind bars for the rest of his life for the kidnapping charge, which many thought would be tossed out due to lack of evidence.

JACKSONVILLE, Fla. -- A corrections officer with the Jacksonville Sheriff's Office was arrested on driving under the influence and other charges after a single-vehicle wreck on Interstate 295 early Sunday.
According to the arrest report, Officer Scott Perry was in uniform when the Florida Highway Patrol arrived at the scene of the wreck on I-295 at the New Kings Road exit about 12:30 a.m.
Perry, 30, told a trooper he lost control of his Dodge Durango while reaching for a cheeseburger. The FHP said Perry was unsteady and appeared impaired and his eyes were bloodshot and glassy.
The FHP said Perry consented to a field sobriety test, which he failed. Troopers also reported finding codeine, Demerol and Xanexl painkillers in his possession for which he had no prescription.
Perry told the arresting officer he was holding the drugs for his brother.
Perry was arrested on charges of DUI, armed possession of illegal drugs and drug possession. He was being held on $27,000 bond.

Just thought I would give a few crimes equal play time. I thought this forum was to help people with immigration problems. I didn't know it was a place to rant and rave about illegals. All I seem to find is comments and news reports about crimes involving illegals. I fail to see what those crimes have to do with people discussing the immigration process. So, I thought that I would remind people about other crimes that might not involve illegals. I am not sure about some of these people after all they committed crimes, they might be illegal.
