  • Impact of changing employers to LCA

    Hi,

I am a new member to the discussion group and I tried searching for answers among the threads but I cannot find one, so I am posting this message so anyone can provide an answer if he has one.

I have an H1B and currently petitioned for a GC by my employer. My employer is an IT subcontractor that deploys us to several companies. Lately, my employer was not able to renew these subcontracting jobs and we are all now on "stand by".
Question 1: Our papers are in the state level DOL. If I find another company willing to take over my H1B, and the H1B is transferred to this other company, do I lose my GC petition?
Question 2: I am already on my extension of H1B. Time is running out on me since my papers are stuck at the DOL. How do I legally extend my stay in the US? I cannot count on the original petitioner because it is currently having financial difficulties and may not be able to survive the year.
Question 3: Can another company or organization file a petition for GC for me under a different visa category?

    Thanks.
