    Should I go or should I not go to the hearing?
    The lawyer said the case will be drop if i don't go.

      You've to answer that question yourself. Does the possibility of financial windfall from winning the lawsuit offset the chances of getting aprehended by ICE/USCIS and deported?

        If I were you, I would take the H-1B thugs to the cleaners. I beleive CIS will not touch someone involved in a unpaid wage suite.

        I am not an attorney, so speak to your attorney before you take action.

          Would CIS know about this hearing then?
          Is this not a DOL matter?
          Having a new sponsor would help me from being deported?
          I heard this company have not cancelled my visa but not sure.

                I will let you know how this ended when I come back. And might reveal to you the company name in private. My hearing is on the 29th. Thanks for your opinion. I appreciate it. Wish me luck!

                  Everything went well with the hearing. It was not a hearing actually but an arbitration. My previous was there and he immediately admitted wrong doing and signed the certificate of indebtedness. No payment was made yet. He promise to pay in 10 days (I hope). As what my lawyer said, non payment of salary has no relevnace to status or visa type. The commissioner never asked questions like visa status or citizenship.Thanks for your inputs.
