    The fact is that the mother will need an immigration attorney.

    If the mother doesn't know a good immigration attorney that specializes in her particular case, and she doesn't know anyone personally who can refer her to one, the most reasonable thing to do is to ask USCIS for help. She doesn't have to disclose all the information about her case to USCIS, she just have to ask for a referral to local non-profit organizations that will assist her with her case.

    Thanks for you suggestions. If the mother goes to the uscis would this not cause problems if the answer is 'no chance' and possibly end up in deportation? Maybe the lawyer route is the best at this stage? I would have imagined that the one status depended on the other when becoming a lpr.

    attorney that specializes in special needs cases. eg a mentally handicapped, over 21, legally entered on a H-4 - now expired - needs to be issued with a visa/? for permanent residency as a dependant (totally) on mother,a green card holder.
    Desparate to sort this dillema out.
    A LPR mother might be able to adjust the status of her hadicapped child.

    If you can't find or don't know any immigration attorney that specializes in such cases, contact local USCIS District Office and ask for help.
