  • AOS for mom (overstayed visa) of USC

    Is it possible (due to any recent change in law or in practice) to do AOS for the mom (70+) of USC who overstayed her visitor visa? Anybody has any idea or experience?

      Yes, you can sponsor her by filing I-130. She should also submit I-485 AOS, I-765 and other papers together with your I-130. Since, she has just overstayed Visit Visa, she will be allowed to adjust status in the United States.

        Thanks. I know the rule is there. However, I wonder if now INS is denying such cases on overstay ground.
