I have a friend who I think is a bit of a dreamer. She is a visa overstay here and lost her passport and I think her I-94. At the end of last year she married a USC, but he wasnt working at the time and he still doesnt have a job now.

She somehow thinks that if she has a baby by him, she will become legalized. I dont think so. Who is right?

Having a baby will not do anything for her, it won't speed anything up, it won't make her legal.

What she needs to do is get a new passport, and ask for a replacement of her i94 and file for adjustment of status.
Her husband needs to find a job so he can sponsor her or they need a joint sponsor.

You're friend can't be legalized by having a child. I suggest her husband finds a job quickly, & files his taxes so that he can prove he can support her (& a child) in the future when she applies for her "green card". Depending on how long she has overstayed and if she does leave the USA (when she gets another passport etc) she may not be able to return to the USA for 3-10 years.
