    Anyone who is willing to help. It will be greatly appreciated. My husband was petitioned by his father in 1991 a LPR petitioning for his unmarried son. However, as you know now he is married now. I want to know, if he qualifies to be grandfathered under 245I now that he is married to a USC? Help I am desperate.

                  Janky1. Since he is now married to an US citizen he is forgiven for his unlawful presence.
                  You both can visit your local BCIS District office and file for family based adjustment. You as the petitioner will file for the I-130 and your husband files for his residence based. Since this is a family based case, you will need to file for an I-864 affidavit of support. If your salary does not meet the privailing wage, you can find a co-sponsor.

                      Will he be protected under 245i or will he have to adjust status abroad. Please let me know anyone willig to help
