A friend just got busted at TJ MAXX for shoplifting stufff for $19.98 they said thay would keep the paperwork in the store that it would not affect his record but the guy is worried .do you think he will be fine for his AOS? and the background check?

Does shoplifting count toward AOS background check?

If the records are kept only at the store the background check will not reveal it. Your "friend" would have to have been arrested. If your friend was arrested and booked then the background check would show that information. Stores typically do not report that kind of petty theft but tell your friend to keep their hands in their pockets or it will happen again and they won't be so lucky.

If the store kept the paperwork and did not report the shoplifting to the police, it will not turn up on an AOS background check.
Please note, however, that the AOS background check pulls the applicant's entire "rap sheet", and it shows all arrests, not just court convictions. Even if the charges are eventually dropped, the arrest will still be there, and applicants for AOS should be prepared to explain it to BCIS.
