  • Help! Can my mother overstay her I94 after receiving approved I512L

    Hi,
    Can someone help me with this?
    My mother just received her approved I512L 4 days ago. The date she has to leave the country mentioned on her I-94 is September 25th. Can she overstay her I-94, and if she can how long she can stay here? will that be a trouble when she come back?

    I would really appreciate your input

      what! another camel herder? why does mommy want to break the law and stay without permission? why? did she apply to all kinds of benefits that she's NOT entitled to? I bet she did. And she wants to come back to collect some more? follow the rules moron!!!

        If your mother was paroled, how long was she paroled for? If she was given advanced parole and returns, then she can stay until the purpose of her parole is accomplished, such as adjusting status.

        Once paroled, any previous admission, such as a B-2 status, is cancelled.

          She was not paroled. She just received the AP and she wants to leave the country. Does she have to leave the country before 25th or can she stay after that?

            Advanced Parole must be used before the expiration date on the Advanced Parole. Your mother no longer has the status she entered the U.S. with.

              I got it fedrale! Thanks. So I guess since she applied for AP before the expiration of her I94 she has no out of status days.

                  Yes, once you apply for AP, you are no longer in the status you had. AP is for those who end their status and seek another.
