    This testimony is very enlightening...I think the best way to deal with this particular issue is for Congress to suspend altogether the Diversity Visa Lottery Program.

                  Poster "Case of Mr. HESHAM MOHAMED ALI HEDAYET" says:

                  "In addition, Mr. Hedayet's AOS application was filed with payment of the additional penalty sum, as required under section 245 (i) of the Immigration and Nationality Act (INA).

                  ===> The INS Los Angeles District Office had jurisdiction to adjudicate the application despite the fact that an Order to Show Cause (OSC) had previously been filed with the Immigration Court.

                  The controlling regulation at that time was found in 8 CFR 245.2(a)(1) as in effect on January 1, 1997, and states, "After an alien has been served with an Order to Show Cause/Warrant of Arrest, his application for AOS under section 245 of the Act or section 1 of the Act of November 2, 1966 shall be made and considered only in proceedings under part 242 of this chapter. Former Part 242 referred to deportation proceedings within the purview of the Immigration Court. In this case, the record clearly established that the OSC had *not* been served upon the Mr. Hedayet and, therefore, that INS had jurisdiction over the
                  application.

                  ===> At the time Mr. Hedayet filed his AOS application, INS had discretion to serve him with a copy of the OSC, or to adjudicate the application. If INS had decided to serve him with the charging document, the Immigration Court would then have had jurisdiction to adjudicate the AOS application. As a general matter, INS exercises favorable discretion as early in its processes as possible in recognition of the government's and the alien's interest in avoiding unnecessary legal proceedings. Although Mr. Hedayet's record does not reflect the decision process not to serve him with the charging document, it would have been considered an unnecessary step to do so when he was 'prima facie' eligible to adjust his status."


                  WELL, HE WAS NOT SERVED WITH THE CHARGING DOCUMENT, AND THAT WAS WRONG! AT LEAST SHOULD HE HAD BEEN SENT TO IMMIGRATION COURT TO PROCESS THE AOS APPLICATION FOR WHICH HE WAS ELIGIBLE, HE WOULD HAVE BEEN SUBJECTED TO SOME DELAY AT LEAST!

                          Why should people who came here illegally or overstayed illegally (with the exception of minors) awarded for intentially breaking U.S. laws?

                          You want to come here, the DVD is the best and most equal opportunity for all! It's a lotto as its name implies, and every qualifying applicant goes through a vigerous check. Most DVD participants are highly motivated, highly trained persons who play year after year to get a shot at it, never breaking the laws here!

                          The DVD should be even expanded to a minimum of 200,000 people and the adjudication of illegals here should be eliminated!

                          Another proposed law, the "guest-worker" program is just as bad of an idea, since it creates a second class citizendry as almost any European denial politics of the past 40+ yrs. can testify!

                            There is no DVD...you could call it DVL (Diversity Visa Lottery) but DVD????
