    Does any body know if common law marriage for five years would good enough for the immigration service for an immigrant petition?
    note: common law marriage is as legal as legal marriage in the state that Ilive in.

      Provided that this form of common law marriage is an acceptable form of marriage in the state in which you reside, this should normally be sufficient for BCIS purposes.         Why don't you just go down to the court house and get married? It would probably make things a lot easier. You need to send in a copy of your marriage certificate with the petition.

          I believe the immigration would like to see the marriage formalized in the best possible way (marriage certificate, etc.)

            State law will determine the validity of a common law marriage. Some states, such as Texas, will recognize a common law marriage, but still require the marraige to be registered. I agree with the previous posts, that you should just go to the courthouse and get married.

              Do you guys know where someone can search which state allows common law marriage, and which states don't? (a webaddress of course)
