If one overstays, and then leaves the country, and the comes back in, how does the INS find out that the person overstayed, especially if that person overstayed for only a month or two, assuming that there is NOTHING in the passport to indicate that?

When re-entering USA, how can INS detect overstay?

Since late 80's, the INS has all records in the computer about exit and entry. On the other hand the law is 'if you overstay, even for a single day, your visa is automatically cancelled.' If they have made this law, they know what they are doing. Donot take risk to overstay. If you plan to extend your visit, just apply for extention to the INS.
