  • Children born in the US

I came with my wife to the US in 1998 - both with a B2 Visa - and overstayed. Our son was born two years later in California. I've heard that certain Law benefiting illegal immigrants parents of children born in the USA could be reactivated soon by the Congress. Is that true?

Where did you hear that?It will never happen, you can feel the anti-immigrant sentiments that's going around in Washington nowadays. They won't even extend 245(i) although the President tried his best to have it renewed. With the war that's in the horizon, I doubt it if they will do something for the immigrants these days. We'll see what will happen next year...

Check with INS (5 times) or with an attorney. You run no risks by making a phone call.

Many times people born within the USA with a US birthcertificate to prove it may be considered US citizens!
