  • H1 to Student Visa

Is it possible to change status from a work visa (H1-B) to a student visa (F1) in the United States? Or is it necessary to go back to the home country to get the F1 visa?

Yes, you may change your status if you are in still in valid status as an "H" and you meet the requirements for an "F". File INS form I-539. You will not have a new visa though, only status as an academic student. You will remain in valid "F" status as long as you are in the US in an appropriate course of study. If you leave the US, you will need to go to the Consul and get a visa, but certain US Embassies/Consulates have a tendency to deny these. If you are not a millionaire or from a country such as England or Germany, and plan on leaving the US within the next four years, you may want to go home and apply for an "F" visa instead of changing status with the INS.
