    please try to answer this question.

    My brother ex spouse was a USC. He got his conditions removed on JULY 2002. His initial approval date for his conditional card was jAN 2 2000. Now does since he not married anymore he cannot apply using 3 years as lawful permanent resident rule. He need to wait for 5 yrs.The question is that does the waiting time include 2 yrs from jan 2000-jan 2002. in that case he will have to wait only 3 years. Please correct me if I am wrong
