A GC holder marries, convert the category to IR later ?

Hi all,

I'm a newly GC holder. I'd love to marry my girlfriend and file the I-130 for her. My question is, after I obtain citizenship, do I have to convert the I-130 to be Immediate Relative category OR it's automatically done so ? And how can I do this conversion if I have to ?

the I-130 is approved while I'm still a GC holder. INS won't work that fast. But of course I will have an INS Receipt by the time I obtain citizenship.

As soon as you receive your Citizenship, send a copy of your Citizenship with a letter to INS requesting them to upgrade your petition from F2 to IR. You should send copies of whatever papers you have received from the INS with that letter. If the petition is approved by that time and file is sent to NVC, then you should write to NVC for upgrade of the petition.
