    Hi everyone!

    Does anyone have any experience, or answer to the following situations?

    Let's say someone who has been married to the USC about six years and he/she just got his/her 10 yrs green card in the last six or seven months. Mean while, he/she applies for Citizenship and his/her citizenship application is being processed.

    The questions are:

    What will happen if the USC spouse divorce him/her now?
    If, the USC spouse divorce him/her now, will it affect his/her citizenship process?

      Explain better your situation please.

      Are you a PERMANENT RESIDENT OR A CONDITIONAL PERMANENT RESIDENT? HOW LONG HAVE YOU BEEN A RESIDENT FOR? ARE YOU APPLYING UNDER THE 3 YEARS RESIDENCE REQUIREMENT BASED ON A MARRIAGE TO A USC OR ARE YOU APPLYING WITH THE 5 YEARS RESIDENCE REQUIREMENT?

        Yes, I am a permanent resident. I filed an application to remove my conditional resident on July 23, 1998 and got interviewed December 2002. I got my green card in March of this year. On April, I applied for citizenship and I had fingerprinted in May.

          I believe I am applying under the 3 years resident requirement.

          On my green card it says it was issued on July 23, 1998 but I received the card in March.

          How do I count this?

            If you applied under the 5 years, which I believe is your case from 98 to 03 there are 5 years, when did you apply? If you apply under the 5 years residence requirement you are FINE.
            Now if you apply under the 3 years residency requirment + marriage to USC you might run into problems... better check with your lawyer how was your naturalization form filled...
