Hey Everyone,
I hope everyone had a great X-mas break and are also enjoying the new year. I wish you all a good New Year and may next year be more brightful for everyone. I need to have a question answered. I know my Fiance will be having her Interview at the US Embassy in Mumbai. But my question is that when I look at the US Embassy of Mumbai website they do not tell if Fiance petition which is I-129F also called K1 is a immigrant or non-immigrant visa. So I went to the New Delhi website and they donot list K1 under there Non-immigrant Visa so I wanted to know has K1 changed from a non-immigrant visa to an immigrant visa. If some one can please reply.

The K-1 visa is a non-immigrant visa good for 90 day. After you marry you must petition again with evidence of marriage etc. to adjust her status. After the processing time (usually a few months) your wife becomes a LPR, an immigrant, with a 2 yr. condition attached to it that again needs to be petitioned to be removed etc. (other discussion on this board).

Make sure she doesn't travel or work with expressed permission when (conditional) LPR status is still being proceesed. Best is to try to obtain a ss# while still with the valid K-1 visa, work authorization and prove of marriage! Congrats!

Ok you both are correct sorta. The K-1 Visa is treated by the embassies or consulates as an immigrant visa not a non-immigrant visa. My fiancee had three interviews at Mumbai and we are now in Admin review. It seems there is a trend and if you are both Indian then you will probally get the visa, it seems intraracial couples are kept waiting. Good luck.

Both are non-immigrant visas. They are not immigrant visas as all.

Admin Review mean Embassy smelling rats. Some thing fishy.

the k1 is not a visa that creates an immigrant application. It's just a visa to temporarily travel to the us to get married and THEN you file for an immigrant visa (adjustment). You can still quite easily not get married and go back.

Tak.. Mumbai embassy smells rats for 99.9999% of all interviews thru their doors. Are you familiar with them?

The K-1 is a non immigrant visa with an immigrant intent. Obviously they gave it to you expecting you to get married and file for adjustment. But out of 100% it's considered 'immigrant ' only 20% but not written anywhere.
