I was removed in April of 2001. I had a conviction for bank embezzlement. I lived in the U.S. for 15 years and my husband and daughters are citizens. Can I apply for an I-212 waiver? If I can, can I apply it in New York where my family resides. Is it possible to get a non-immigrant visa? Or am I banned for life to go back to the U.S.

My situation is this. I was an H1 visa holder then I received my green card in 1993. In total, I was living in the U.S. legally for 15 years before I was removed. No other criminal record but embezzlement. I feel like I killed somebody. I want a non-immigrant visa to accompany my U.S. citizen daughter to apply to schools in the U.S. Are there any lawyers out there who has handled I212 waivers. Please help. Is it really impossible to get a waiver? So meaning I am banned for life?

Didn't you hire any lawyer when you were under deportation?You could have fought your case if you had a very good lawyer. Just in the case of St.Cyr, he was convicted of more serious offense yet he was able to get a relief. I forgot everything I read about his case but if you have time try to read it.It might give you some ideas..BTW are you still married to your USC husband? How old is your daughter? The reason I ask because it might help you in your case.

Brownfox, I did hire a lawyer and spent a lot of money. But getting a good lawyer is not easy, finding an honest one is like looking for a needle in a haystack. I now has such an aversion to lawyers, but there is nothing I can do I need one. I haven't read the St. Cyr case, but I would appreciate it if you could tell me when it was posted so I can look it up and maybe he can recommend his lawyer to me. My USC husband, is no more, although on paper he still claims he is still married to me for tax purposes. Remember, I was ostracized. My daughter is 16 years old. I am so disillusioned with the legal system but I can't fight it. Even if he petition for me, I still need a waiver and might take longer. How do they review waivers? Do they look at an individual's background? There's nothing they would find in my file except for that one charge. I have walked a very stright life so God only knows why this happened to me. If you knew a good honest lawyer, let me know.
