    hello i am an indian who returned from u.s. in 1997
    i have a green card and it expires on 2006
    now i went twice since to the u.s to "renew the greencard"
    and last i went is 2000
    since then i have not gone
    now i want to go for higher studies(MS)
    there is a rule that if u stay outside the u.s for more than two years it becomes invalid
    so what do i do
    can i apply for a student visa and go to the u.s
    and then activate my greencard through a lawyer
    will theis be possible
    pls reply friends

      green card is never invalid. go the consulate near you and pay the fine.

        What fine?

        If you have a green card and leave the U.S. for more than 12 months without filing the correct form (and that only gives you 2 years) you are considered to have abandoned your permanent residence.

        You could come back on a student visa, but don't count on "reactivating" your green card. You would have to prove that you did not abandon the U.S.. Unless you were in the U.S. military or worked for a U.S. company thats not possible.

          May be fine is not the right word, but you have to pay in money to get back you green card in good standing. You may be right when you said a green card is considered abandoned after two years but it is subject to reactivation.

          My antie was out for more than 2 years and she paid $800.00, She has someone do the thing or whatever you call it. So with my relative who stayed out of the U.S. for 5 years studying high school in his native country and he was able to come back, both are green card holder, they came to U.S. ON different times.

            I stand corrected, I check my info. and it is not true. I thing if you were out that long, you have to prove, as was siad that you did not abandon your green card.

              so what u guys are sayin
              thats it my green card is gone forever
              i bet some lawyer can pull off some stunt
              some lawyer must be able to do something
              right
              u r tellin me i have to go thro the process
              again!!!!! ahhhhhh

                You have abandoned your "permanent residnce" in USA and thus forfeited your right to liver permanently in USA

                If you believe that the a lawyers can do fancy footwork for you, then you are wasting your time on this forum.

                Go and consult a lawyer and start your fancy footwork

                  Green Cards have a purpose. They allow you to live and work in the U.S. - they are not for the purpose of having 'In Case' you want to return to the U.S.

                  Your GC is abandoned and you will have to start all over again. Of course, it may be worth a consultation with a lawyer but I would be very careful. If they tell you they can fix it for you, they are most likely lying!
