According to the Laws you have become an illegal, you have no work permit no stamped in a passport saying your AOS has received and pending.....

All immgration matters should be in black and white.
That's called lack of knowledge of Laws, INA and CFR...God Bless America...

Whether you have a work permit or not does not affect that your case will be denied for fraud. Having a bank account in two names will not help you.

Thank you guys, I will give them until the end the month if no answer I will renew my work permit, just dont want to put out the $340, then my interview come through, just dont know why they reschedule my appointment thats strange all they wanted was more evidence, My wife got a work and she is trying to hook me up with a space there, I just cant just go there and sit down do nothing while my kids take the burden especially my son I am the sole provider for him.

They are doing what's convenient for themselves not what's best for you trini752002. However it is true if married to a USC, illegal work is forgiven (usually).

I might want to add that at my interview (I had a similar situation), my work permit had already expired, the officer told me I can continue to work and wrote in and marked my passport as AOS pending with his name and number.

Appearently, USCIS is not all that strict with work permits while AOS is pending.

Exactly. That officer has no idea what the final decision is going to be or how long it will take for the adjudicating officer to make that decision.

Officer gave you defective advise. Forget about her and apply for work authorization. Officers are not always right.

Mrs Mani you think I should still apply for the work permit, I understood what the officer was saying she pull up my files on the pc she said if I apply for the work permit they would send a receipt but it will take like 2-3 months for them to ship it by that time I should already get a decision.

The officer told me not too apply because my interview will be soon, even if I apply for work permit it takes time to get it she said by that time I should already get my interview and they will make there decision.

The lease is on both my wife and I, I am moving there as soon I get a work just dont want to leave my work to go there to sit down we got alot of things with our both names on ibank account, auto insurance, etc..

She said you don't have to but not that you couldn't. You are now working illegally. Isn't it better to try to work legally? The officer you spoke with really has no idea what is going to happen at the interview or how long it will be before you get your green card.
