      I have no idea what that web page is talking about. Maybe after they post more information, it will make sense, but I doubt it. I think this is just a shill for a law firm trying to drum up work.

      There have been no changes to the H-1B regulations regarding benching of employees. If an employer "benches" a H-1B worker, the employer is legally required to pay that employee the wage guaranteed on the LCA for that H-1B worker during the benching period. Benching also carries the possibility of additional penalties for the employer.

      DOL does allow employers to include a limited liquidated damages clause in the employment agreement with the H-1B worker (something along the lines of "if the employee resigns within 1 year of employment, the employee owes $2500"); however, DOL will not allow an employer to enforce a liquidated damages clause that is outrageously large or clearly unreasonable (i.e., damages of $25000).
