Your situation is really critical because I-130 is received at Service Center on 21st birthday of your son. INS argument will always be that the day they received I-130 your son was not 21, he had crossed the prescribed age limit.
CSPA says date of filing of I-130 which understandably is earlier than date of receipt in INS office. Like one files Income Tax Returns on April 15 at the post office, under the postal law that return is considered filed on that day.
As such, you will have to convince INS about this. May be you will have to seek services of a seasoned Immigration Attorney.
